General

“CAS”, “us”, “we” or “our” means Contractor Accommodation Services Limited with registered number 6323037 of registered address 314 Regents Park Rd, London, N3 2LT. Information on our service, terms and conditions and privacy policy can be found on our website www.wedotherest.com (The “Site”).

CAS acts as booking agent. By using our service you agree to these Terms and Conditions, the Privacy Policy and the Terms of Use (“the Terms”) and you expressly consent and agree to be bound by the Terms and all applicable laws and regulations that govern your booking.

References to “accommodation providers” means the owner/providers of the B&Bs, hotels, serviced apartments, holiday cottages, villas and other accommodation of any description recommended and/or booked by CAS and “accommodation” means the accommodation including all facilities and services that we have agreed to arrange in connection with your confirmed booking.

Important Information

CAS acts as booking agent only in respect of all bookings we make on your behalf, compiling and transmitting the details and requirements of your reservation to the relevant accommodation provider and sending you a confirmation email for and on behalf of the accommodation provider.

We undertake no responsibility for and are not liable for any misrepresentations, breaches of contract, breaches of statutory duty or negligence of any of the accommodation providers and other suppliers of services offered through us or other third parties. This means that in the event of you suffering personal injury, illness or death as a result of any act or omission of an accommodation provider or other supplier of services (or their employees or agents) or you having any complaint about the quality of the services provided or having any other complaint at all, your sole right of redress will be against the independent third party who provided such service and CAS will be under no liability at all (whether in contract, tort or otherwise howsoever).

By using our service, you accept that CAS has not in any way selected, assembled or compiled any travel arrangements for you. Your accommodation arrangements are not a package or part thereof and therefore do not fall under and/or within a Package Holiday, Package Travel and/or Package Tours Regulations 1992.

By proceeding to book accommodation and/or other services through CAS, you accept that you will be entering into a contract with the accommodation provider on their standard terms and conditions. Although not undertaking any liability to do so, CAS will endeavour to make available to you any relevant accommodation provider’s terms and conditions.

You understand that CAS may not have conducted any quality or other checks on the accommodation providers and CAS makes no representations or warranties about the suitability and/or quality of the accommodation and/or services offered by the accommodation providers we suggest and subsequently book on your behalf on your request. CAS offering and/or reserving accommodation and/or services to and for you in no way constitutes an express or implied endorsement or recommendation by CAS of such accommodation or services. We do not guarantee the accuracy of, and are not liable for any inaccuracies relating to the accommodation and services offered for sale through us.

You undertake to carry out your own due diligence on any accommodation booked through CAS and you are fully responsible and liable for choosing the most appropriate accommodation. Some accommodation providers offer an advanced purchase and non-refundable rate. We always recommend that you visit and inspect the accommodation before committing and paying for the accommodation. CAS bears no responsibility or liability for any accommodation that is not suitable and any redress will be with the accommodation provider directly.

You understand that whilst CAS endeavours to provide a comparative list of negotiated options, there may be alternative accommodation options which have not been recommended and/or offered by CAS, which may be cheaper or more expensive and of an inferior or superior quality. You undertake that it is your responsibility to carry out your own due diligence to ensure that the accommodation option offered by and booked through CAS is suitable and to your satisfaction.

Nothing in these terms of use shall operate to exclude or limit the liability of CAS for fraudulent misrepresentation or death or personal injury caused by our negligence.

Where you, or any of the people that you are booking on behalf of, are in breach of any of the provisions of these Terms or contravention of any laws or rights of a third party, we reserve the right to cancel your booking without refund or compensation in any way and recover from you any costs incurred as a result of your behaviour.

You warrant that you are 18 years of age or over and have legal capacity to create a legally binding contract.

You warrant that all personal information submitted during accommodation booking is correct and you accept financial responsibility for all transactions made under your name or account.

You hereby authorise CAS to process all Personal Information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed to include, but not be limited to: any telephone numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group.

CAS is not to be considered as a party in litigation, nor shall it or any of its employees be required to be a party to any litigation arising directly or indirectly from the booking of accommodation.

Free of charge

Our service is offered Free of charge. We will not charge you for our service. We will not charge your credit/debit card. Payment for your stay will be made directly with the accommodation provider.

Site content, documentation and booking information.

CAS may modify the content of the Terms at any time, and such modification shall be effective immediately upon posting of the modified Terms on the Site and your continued use of our service or access of this site will be deemed to indicate your acceptance of the modified content and/or Terms.

Any information provided to you by CAS relating to accommodation including, but without limitation, details of the accommodation, the price of the accommodation, the facilities available at the accommodation, any accreditations afforded to the hotel and/or any details relating to any other services herein is based on information supplied by, and literature based on, the accommodation and/or service providers who are independent businesses and are not agents or employees of CAS. Such information does not constitute any advice or recommendation given by CAS and CAS shall not be held liable for inaccuracies or errors in the accommodation contents or any of its elements. These independent businesses provide the services in accordance with their own terms and conditions which may limit or exclude their liability to you. CAS is not liable for any acts, omissions, breaches or negligence of any such independent businesses or any damages or expenses resulting from the aforesaid. CAS and its affiliates are not liable for any refunds in the event of overbooking or force majeure or any other cause beyond their control.

As CAS acts only as a booking agent we will have no responsibility for any errors in any documentation except where those errors were made by CAS.

Credit card or bank transfer

When CAS make a reservation on your behalf, accommodation providers require credit card details in order to secure and guarantee your reservation. As such, we will verbally ask and transmit your credit card information directly to the accommodation provider at which your reservation is made. The accommodation provider may verify (i.e. pre-authorise) your credit card and we will notify you of this in advance.

For certain rates, such as non-refundable advance purchase rates or special offers, the accommodation providers may require that payment is made upfront by bank wire transfer (if available) or by credit/debit card, and therefore your credit/debit card may be pre-authorised or charged in full upon making the reservation, sometimes without the facility of for refund. Please check with us for any such conditions prior to making your reservation.

CAS will verbally transmit your card details to the accommodation providers and safely and securely destroy your card details once these have been transmitted to the accommodation providers in line with our data protection policy.

Each accommodation provider is required to comply, and to have its sub-servicers comply on an ongoing basis, with the requirements, compliance criteria and validation processes as set forth in the Payment Card Industry (“PCI”) Data Security Standard as promulgated from time to time by the major credit card companies. CAS is not liable and/or responsible for accommodation providers carrying out their Data Security policies and CAS cannot be held responsible in the event of credit/debit card fraud or unauthorised use of your credit/debit card by accommodation providers and/or other third parties.

Please make sure that you report any misuse or fraud to your credit card provider (in accordance with its reporting rules and procedures).

Booking accommodation or other services

By making an accommodation booking through CAS, you warrant that you are authorised to make the booking by and on behalf of all persons named on the booking when the booking is made. By securing accommodation and making a booking with CAS, you are confirming that all persons named on the booking accept these Terms and that you will inform all other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due under the booking.

To make an accommodation booking, simply inform CAS of your preferred accommodation option, your dates required and CAS will make the reservations on your behalf.

In order to complete your accommodation booking, CAS will request and submit to the accommodation provider, your personal information, such as your name, email address, telephone number and credit/debit card details (“Personal Information”). Whenever you provide such Personal Information, CAS will collate and use such Personal Information in accordance with its “Privacy Policy”, which should be read in full in conjunction with these Terms before providing any Personal Information to CAS.

YOU AGREE TO THOROUGHLY CHECK ALL BOOKING CONFIRMATIONS TO ENSURE THAT ALL DATES ARE ACCURATE AND TO INFORM CAS OF ANY ERRORS WITHIN THE CANCELLAIOTN POLICY TO NOT INCUR AND CANCELLATION OR AMENDMENT FEES. CAS WILL NOT BE LIABLE FOR ANY CANCELLATION AND/OR NO-SHOW FEES IN RELATION TO YOUR BOOKINGS

Your decision to rely on our Service is entirely your own risk and responsibility and, whilst CAS will do everything We can to deliver the Service to You in accordance with the dates requested in your Booking, delivery times may be affected by factors beyond our control and cannot be guaranteed. In particular, We will accept no liability should any late Booking of accommodation or failure to secure any accommodation result in loss, damage or inconvenience to you whatsoever or mean the inability for you to start your contract on time.

Confirmation

CAS will confirm your booking and provide you with a full email Booking Confirmation. Please note that CAS will not deduct any money from your credit card. The accommodation and/or other service provider which we book on your behalf and with which you enter into a contract, will take payment.

Please note that in the event that you are called by CAS, or you call CAS regarding your booking, calls may be recorded for monitoring and training purposes. In the event of a dispute regarding a booking, CAS reserves the right to review any call information.

Cancelling and amending your booking

You may modify or cancel your booking (where applicable) prior to your arrival date and within the cancellation terms as detailed in your Booking Confirmation.

If you cancel or amend your booking, there may be a cancellation or amendment fee charged by the accommodation or other service provider. In any event, it is your responsibility to cancel or amend your booking in accordance with the provider’s cancellation and/or amendment policy (where applicable) to not incur a cancellation or amendment fee by the accommodation or other service provider.

Full details of the cancellation policy and methods to cancel or amend your reservations are clearly set out in our Booking Confirmation email to you.

If, for whatsoever reason, you do not turn up at the accommodation on any arrival date stated on your booking confirmation email, without prior warning to CAS or the accommodation provider within the cancellation policy (“a no show”), this shall be considered a cancellation. The accommodation provider may charge you a cancellation fee using the credit/debit card details that you provided when securing/guaranteeing your booking.

Failure to arrive at your accommodation on time on the day of your reservation and not informing the accommodation provider in advance, may result in the accommodation provider cancelling the remaining days on your reservation and you may be charged a cancellation fee. Please ensure you review the accommodation providers’ cancellation policy for more details.

Advanced purchase bookings require full pre-payment at the time of booking. This payment cannot be refunded or transferred in the event of cancellation.

Testimonials and reviews

Any testimonial or review provided by you on our service of that of an accommodation provider may be (i) uploaded onto our current or future website for the sole purpose of informing any current or future customers/guests of your opinion of the service and quality of the accommodation and/or our service, and (b) (wholly or partly) used and placed by CAS at its sole discretion (e.g. for marketing, promotion or improvement of our service) on our website or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by CAS and our business partners. We reserve the right to adjust, refuse or remove reviews at our sole discretion. The guest or customer review and/or testimonial is regarded as a survey and does not include any offers, invitations or incentives whatsoever.

Documents before you travel and Insurance

CAS is not liable for damages or losses that may result from travel to any particular destination or accommodation provider.

It is your responsibility to ensure you have any relevant travel and health documents before departure for any country you may visit in connection with your booking made through CAS, which shall include, but is not limited to ID’s and passport. CAS will not be liable for any expenses incurred resulting from your missing, incomplete or incorrect documentation or any non-compliance with requirements.

CAS strongly advise that you take out adequate travel insurance prior to arriving in your destination. It is your responsibility to ensure you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs and the costs of assistance including return to the UK in the event of an accident or illness.

Disclaimer

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).

However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available our service and the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the accommodation as made available on our website or within any correspondence to you from CAS, either electronic or other, (iii) the services rendered or the products offered by the accommodation provider, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) for any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the accommodation (its employees, directors, officers, agents, representatives or affiliated companies), including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

Terms of Use and Site Use

To the maximum extent permitted by law, CAS refutes all implied warranties with regard to any information, services and materials contained on this Site. All such information, services and materials are provided “as is” and “as available” without warranty of any kind.

CAS may suspend access to the website, , to carry out maintenance works or due to net security reasons or force majeure, with no obligation to reimburse or compensate you for the period in which access was suspended.

Access to the Site is strictly controlled by CAS and CAS reserves the right to change, modify, substitute or suspend or remove without notice any information or service from time to time.

You may download one copy of the content of the Site for your own personal use but you may not in so doing remove any trademark, copyright or other proprietary notice. You may not otherwise copy, modify, reproduce, sell, lease, market or distribute the content placed on the Site without the prior written consent of CAS.

You may only use this website to make legitimate enquiries or bookings for yourself or another person for whom you are legally authorised to act.

You may not:

  • post, transmit or disseminate any information on or via this website which is or may be harmful, obscene, defamatory or otherwise illegal, or may cause an infringement of the rights of any other;
  • make any other unauthorised, false or fraudulent booking or enquiry;
  • use any software, routine or device to interfere or attempt to interfere electronically or manually with the operation or functionality of this website including, but not limited to, uploading or making available files containing corrupt data or viruses via whatever means;
  • deface, alter or interfere with the appearance and layout of this website or the underlying software code;
  • take any action that imposes an unreasonable or disproportionately large load on this website or related infrastructure;

Without prejudice to any of CAS’ other rights, CAS reserves the right to deny access to this website and/or cancel bookings wherever and whenever CAS believes (at CAS’ absolute discretion) that you are in breach of any of the CAS Terms.

Links and downloads

CAS provides hyperlinks to other websites which CAS believes may be of interest to visitors of our Site. These other websites are maintained by third parties. These other websites are therefore not under the control of CAS or maintained by CAS and CAS is not responsible for the content of such websites. These links are provided by CAS for your convenience only but CAS does not monitor or endorse the material on them. CAS does not accept any liability whatsoever and howsoever arising in relation to any such other websites and links or in relation to any material or information appearing on them or which you may otherwise come across after leaving the Site by way of a hypertext link or any other means or for any services or facilities of any description which you may book through or via any such website.

Force Majeure

CAS will not be liable for any changes, cancellation, effect o your booking, loss or damage suffered by you or for any failure by the accommodation providers and/or CAS to perform or properly perform any of our respective obligations to you which is due to any event(s) or circumstance(s) if the non-performnance is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe or other causes that seriously affect both parties and other unforeseeable causes beyond CAS’ control.

Complaints or issues with your accommodation

In the unlikely event that you have reason to complain or experience any problems with your accommodation please inform the accommodation reception staff or management immediately, to enable them to take appropriate action.

General

Nothing under the Terms shall give rights to any person who is not a party to it (whether under the Contracts (Rights of Third Parties) Act 1999) or otherwise.

If you or CAS waive any rights in result of a breach or default under any part of these Terms, the other will not be deemed a waiver of any subsequent breach or default. Additionally, it will not affect the other Terms unless expressly confirmed in writing by the party waiving its rights.

If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.

CAS reserves the right to change our Terms at any time. We shall post any updated Terms on our Site and your continued use of our Site shall be deemed acceptance of such updated Terms.

Jurisdiction

This agreement will be governed by English law and any disputes will be dealt with by the English courts.
